1. Applicability and Scope

1.1 This Return and Refund Policy applies to all transactions carried out on the restricted-access B2B platform www.shopayurveda.eu, operated by Svedica B.V. and Authentic Ayurveda d.o.o., and covers products under its trademarked wellness and Ayurvedic brands Art of Vedas® and Nirmal Ayurveda®.

1.2 This platform is exclusively accessible to pre-approved professional users, including but not limited to:

  • Ayurvedic doctors and therapists
  • Licensed healthcare practitioners
  • Pharmacies, resellers, and wellness centers
  • Distributors, wholesalers, and retailers

1.3 This policy governs commercial transactions and is subject to EU business law. Consumer protection regulations (e.g. EU Consumer Rights Directive) do not apply.

2. Return Conditions

2.1 Due to the nature of Ayurvedic medicinal, wellness, and personal care products, returns are strictly limited to cases involving:

  • Manufacturing defects
  • Product damage occurring during transport
  • Incorrect fulfillment by Shop Ayurveda EU

2.2 A product return is only valid if all the following criteria are met:

  • The return request is submitted in writing to info@shopayurveda.eu within 7 (seven) calendar days of delivery
  • The goods are in unused, unopened, and saleable condition, with all safety seals and original packaging intact
  • The buyer provides verifiable evidence of damage, defect, or discrepancy (e.g. clear photographs)

2.3 The following product categories are non-returnable under all circumstances:

  • Products that have been opened, used, or partially consumed
  • Products marked as “final sale” or “non-returnable” at the time of order
  • Products customized, white-labeled, or specially manufactured for the buyer
  • Goods returned without prior written authorization

3. Return Procedure

3.1 To initiate a return, the buyer must email info@shopayurveda.eu with:

  • Order number and invoice copy
  • Product code(s) and batch number(s)
  • Reason for return
  • Supporting evidence (e.g., images, videos)

3.2 Svedica B.V. and Authentic Ayurveda d.o.o reserves the right to request return of the physical product to a designated warehouse. All shipping and handling costs for returns shall be borne by the buyer, unless the return is due to a verified error or fault of the seller.

3.3 Unauthorized or improperly returned goods may be rejected or disposed of without credit.

4. Remedies and Refunds

4.1 Upon validation and approval of the return, Authentic Ayurveda d.o.o may offer one of the following remedies at its sole discretion:

  • Replacement of the affected product(s)
  • Issuance of a credit note to be used on future orders
  • Refund to the original payment method (only in exceptional cases and subject to internal review)

4.2 Refunds and credits will be processed within 14 (fourteen) business days after the returned goods are received and assessed.

5. Limitation of Liability

5.1 Authentic Ayurveda d.o.o. shall not be liable for:

  • Indirect, incidental, or consequential damages, including loss of profit or business opportunity
  • Delays in delivery caused by third-party logistics partners
  • Product misuse, mishandling, or non-compliance with local regulatory restrictions by the buyer
  • Compatibility of products with specific legal or medical requirements in the buyer’s country

5.2 In all cases, the maximum liability of Authentic Ayurveda d.o.o. shall not exceed the invoiced value of the disputed goods.

6. Intellectual Property and Trademarks

6.1 All products listed under the brands Art of Vedas® and Nirmal Ayurveda® are the exclusive intellectual property of Svedica B.V. and Authentic Ayurveda d.o.o, protected under international and EU trademark and copyright laws.

6.2 Unauthorized reproduction, relabeling, or misrepresentation of these brands by resellers or distributors may result in legal action, termination of account access, and loss of resale privileges.

7. Governing Law and Jurisdiction

7.1 This Return and Refund Policy shall be governed by and interpreted in accordance with the laws of Croatia.

7.2 Any disputes arising from this policy or related commercial transactions shall be exclusively subject to the competent courts of Rijeka, Croatia.

7.3 The buyer waives any right to initiate chargebacks, deductions, or unilateral cancellations without exhausting the procedures outlined in this policy.

8. Amendments and Policy Updates

Svedica B.V. and Authentic Ayurveda d.o.o. reserves the right to modify, update, or amend this Return and Refund Policy at any time without prior notice. The most recent version will always be available within the registered user portal of www.shopayurveda.eu. Continued use of the platform implies acceptance of the latest terms.
